These Terms of Service ("Terms") govern your use of the Apex Spine and Sport website, mobile application, and all related services operated by Dr. Dillan Bollwinkel, DC ("we," "us," or "our"). By accessing or using our services — including signing up for communications, purchasing a membership, or using the Apex Spine and Sport app — you agree to be bound by these Terms in their entirety.
If you do not agree to these Terms, please do not access or use our services. We reserve the right to update or modify these Terms at any time. When changes are made, we will update the "Last updated" date at the top of this page. Your continued use of our services after any modification constitutes your acceptance of the updated Terms.

Medical Disclaimer & Health Acknowledgment
IMPORTANT — PLEASE READ CAREFULLY: The content provided through Apex Spine and Sport is for educational and informational purposes only. It does not constitute medical advice, medical diagnosis, or medical treatment of any kind. Always seek the advice of a qualified healthcare provider before making any health or medical decisions.
Not a Substitute for Professional Medical Care. The exercises, guides, videos, protocols, app content, program materials, written communications, and any guidance provided by Apex Spine and Sport — including communications from Dr. Dillan Bollwinkel, DC or the Apex AI coach — are intended solely for general educational purposes. This content is not a substitute for professional medical advice, diagnosis, or treatment. Nothing in this program should be relied upon as medical advice or used to replace consultation with a licensed and qualified healthcare provider.
No Doctor-Patient Relationship. Dr. Dillan Bollwinkel, DC is a licensed Doctor of Chiropractic in the State of Texas. However, your use of this program, app, or any communications from Dr. Bollwinkel does not create a doctor-patient relationship between you and Dr. Bollwinkel or Apex Spine and Sport. The guidance provided is general in nature and is not tailored to your specific medical history, condition, diagnosis, or individual needs unless an explicit in-person or telehealth clinical relationship has been established separately.
Consult Your Healthcare Provider. Before beginning any exercise program, rehabilitation protocol, or wellness routine — including any protocol offered through Apex Spine and Sport — you must consult with a qualified and licensed healthcare provider who is familiar with your personal medical history. This is especially important if you:
- Have been diagnosed with or suspect any spinal condition, disc herniation, spinal stenosis, spondylolisthesis, or related structural abnormality
- Have had any prior spinal surgeries, fusions, or implanted hardware
- Have a history of osteoporosis, osteopenia, or bone density concerns
- Have been diagnosed with or suspect any neurological condition, including peripheral neuropathy, myelopathy, or radiculopathy
- Have a history of cardiovascular disease, high blood pressure, or have been advised by a physician to limit physical activity
- Are currently pregnant or in the postpartum recovery period
- Have any autoimmune condition affecting joints or connective tissue, including rheumatoid arthritis, lupus, or ankylosing spondylitis
- Have a history of cancer or are currently undergoing cancer treatment
- Have experienced recent trauma, fracture, or significant injury to any area addressed by the program
- Are currently taking medications that affect bone density, muscle function, blood pressure, or pain sensation
- Have diabetes or any condition that affects circulation or sensation
- Are under the age of 18
STOP exercising immediately and seek emergency medical attention if you experience any of the following during or after exercise: chest pain or tightness; severe shortness of breath; sudden sharp or shooting pain in the spine, neck, or extremities; sudden severe headache; loss of consciousness or fainting; severe dizziness or loss of balance; sudden weakness or numbness in the arms, legs, hands, or feet; loss of bowel or bladder control; sudden vision changes; or any symptom that feels severe, abnormal, or rapidly worsening.
Pain Is a Signal — Listen to Your Body. Mild muscle soreness during and after exercise is common and generally expected. However, sharp pain, joint pain, radiating pain, electrical sensations, or pain that significantly worsens during or after exercise is not normal and may indicate an injury or underlying condition that requires professional evaluation. Do not push through pain of this nature. Stop the activity immediately and consult a healthcare provider before resuming.
Individual Results and No Guarantees. Results from the Apex Spine and Sport program vary significantly between individuals based on age, baseline health, medical history, consistency of participation, severity of condition, and many other factors. Any testimonials, success stories, or outcome examples shown in our materials represent individual experiences and are not typical or guaranteed. Apex Spine and Sport makes no warranties or representations regarding the specific outcomes you will experience from use of this program.
AI Coach Limitations. The Apex AI coach within the app is an automated AI system designed to provide general motivational guidance and educational information about the program. It is not a licensed healthcare provider, does not have access to your full medical history, and its responses should not be interpreted as medical advice, clinical assessment, or professional recommendation. Always defer to your licensed healthcare provider for any clinical decisions.
Chiropractic Care and Scope. Dr. Dillan Bollwinkel, DC holds a Doctor of Chiropractic degree and is licensed in the State of Texas. The exercises and guidance in this program are within the general scope of chiropractic wellness education. However, the program does not provide chiropractic adjustments, spinal manipulation, or any hands-on clinical procedures. If you require these services, please schedule an in-person appointment with a qualified chiropractor or other licensed healthcare provider.
Emergency Situations. This program is not designed for emergency medical situations. If you believe you are experiencing a medical emergency, call 911 or your local emergency services immediately. Do not use this app, program, or any communications from Apex Spine and Sport as a substitute for emergency medical care.
Third-Party Content. Our program may reference or link to third-party health and wellness resources for informational purposes only. Apex Spine and Sport does not endorse, warrant, or guarantee the accuracy of any third-party content and is not responsible for any actions you take based on third-party information.
Assumption of Risk. By using the Apex Spine and Sport program, you acknowledge that physical exercise carries inherent risk of injury, including but not limited to muscle strains, ligament sprains, joint pain, and in rare cases more serious injury. You voluntarily assume all risks associated with participation in any physical exercise program, including the protocols provided by Apex Spine and Sport, to the fullest extent permitted by applicable law.
SMS Text Message Communications
Apex Spine and Sport sends text messages through a registered 10-digit long code (10DLC) number in compliance with carrier regulations and the Telephone Consumer Protection Act (TCPA). By opting in to receive SMS communications, you acknowledge and agree to the following terms.
Who Sends These Messages. SMS messages are sent by Apex Spine and Sport, operated by Dr. Dillan Bollwinkel, DC, 2750 S. Preston Rd. #105, Celina, TX 75009. Our messaging is powered by GoHighLevel (GHL), a registered and approved SMS platform operating under A2P 10DLC standards.
How You Opt In. You may opt in to receive SMS text messages from Apex Spine and Sport through one of the following methods:
- Submitting your phone number on our opt-in form at apexspineandsport.com/free-neck-rest-guide2/ and checking the SMS consent checkbox
- Submitting your phone number through the Apex Spine and Sport app after purchasing a membership and consenting to SMS communications
- Texting a keyword to our designated number after seeing a call-to-action on our social media or marketing content
- Providing your phone number and explicit consent to receive SMS messages through any other opt-in form operated by Apex Spine and Sport
Consent is not a condition of purchase. You are never required to consent to receive promotional SMS messages as a condition of purchasing a membership or receiving any service from Apex Spine and Sport. Transactional messages related to your account (such as membership confirmations) may be sent separately as part of your membership agreement.
Types of Messages You May Receive. By opting in, you consent to receive the following types of SMS messages from Apex Spine and Sport:
- Welcome messages: A confirmation message sent after you opt in, including a link to your free guide or program resources
- Educational content: Tips, exercises, and recovery guidance related to pain relief and spinal health
- Program reminders: Reminders to complete your daily exercises, log your pain level, or attend live coaching calls
- Progress check-ins: Messages checking in on your recovery progress and encouraging consistency
- Promotional messages: Information about membership offers, trial upgrades, and program updates
- Transactional messages: Account-related messages including membership confirmations, billing notifications, and access updates
Message Frequency. Message frequency varies based on the type of communication, where you are in your recovery program, and your level of engagement. You can always reduce or stop messages at any time using the opt-out instructions below.
Message and data rates may apply. Standard messaging rates charged by your mobile carrier may apply to SMS messages you send and receive. Apex Spine and Sport is not responsible for any charges imposed by your mobile carrier. Check with your carrier if you are unsure about your messaging plan.
How to Opt Out (Stop Receiving SMS). You may opt out of receiving SMS messages from Apex Spine and Sport at any time using any of the following methods:
- Reply STOP to any SMS message you receive from us. You will receive a confirmation message and no further marketing SMS messages will be sent to your number.
- Reply CANCEL, END, QUIT, or UNSUBSCRIBE — all of these keywords will also process your opt-out request.
- Contact us directly at apexspineandsport@gmail.com and request to be removed from our SMS list.
After opting out, you will receive one final confirmation text confirming your opt-out has been processed. Following that confirmation, no further promotional SMS messages will be sent. Please note that if you have an active membership, you may still receive essential transactional messages related to your account, billing, or access — these are not promotional and are a necessary part of your membership service.
How to Get Help. If you have questions about our SMS communications or need assistance, reply HELP to any message we send you. You will receive a response with contact information and support options. You may also email us directly at apexspineandsport@gmail.com.
Supported Carriers. Our SMS messaging is supported by all major U.S. wireless carriers, including AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, Metro by T-Mobile, and U.S. Cellular, as well as most regional carriers. Carrier support for short codes and 10DLC messaging may vary. Apex Spine and Sport is not liable for delayed or undelivered messages due to carrier limitations.
Privacy of Your Phone Number. Your phone number and any information you provide when opting in to SMS communications is handled in accordance with our Privacy Policy. We will never sell or rent your phone number to third parties. Your number is used solely for the purpose of delivering the SMS communications you have consented to receive from Apex Spine and Sport.
Changes to SMS Program. We reserve the right to modify or discontinue our SMS messaging program at any time. If we make material changes to how we use your phone number or the types of messages we send, we will provide notice through our website or via email before those changes take effect.
Email Communications & CAN-SPAM Compliance
Apex Spine and Sport sends email communications in compliance with the CAN-SPAM Act and all applicable email marketing regulations. By providing your email address through any of our opt-in forms, checkout pages, or app registration, you consent to receive email communications as described in this section.
How You Opt In. You may receive email communications from Apex Spine and Sport by:
- Submitting your name and email address on our opt-in landing page to request a free guide
- Purchasing a membership through our checkout process
- Creating an account in the Apex Spine and Sport app
- Providing your email address through any other opt-in form operated by Apex Spine and Sport
Types of Emails You May Receive. Depending on how you opted in and your relationship with us, you may receive the following types of email communications:
- Welcome and onboarding emails: Sent immediately after opt-in or membership purchase to confirm your access and guide you through getting started
- Free guide delivery: The PDF guide or digital resource you requested delivered directly to your inbox
- Educational email sequences: A series of informational emails about pain relief, recovery strategies, and spinal health, typically delivered over several days or weeks following opt-in
- Promotional emails: Emails about membership offers, trial upgrades, discounts, and program launches
- Weekly progress emails: For active members, a weekly summary of your recovery progress including streak data, pain trends, and milestone achievements
- Program and membership updates: Important updates about the app, new content, protocol changes, or membership terms
- Billing and transactional emails: Receipts, renewal confirmations, payment notices, and account-related communications required as part of your membership
How to Unsubscribe from Marketing Emails. You may unsubscribe from marketing emails at any time by clicking the "Unsubscribe" link included at the bottom of every marketing email we send. Upon unsubscribing, you will be removed from our marketing email list within a commercially reasonable timeframe (typically within 10 business days as required by the CAN-SPAM Act).
Please note: if you are an active paying member, unsubscribing from marketing emails will not affect delivery of transactional and account-related emails that are required to maintain your membership and access to the program. These emails include billing confirmations, access notifications, and password reset messages.
CAN-SPAM Compliance. All marketing emails sent by Apex Spine and Sport comply with the CAN-SPAM Act, including the following requirements:
- We never use false or misleading header information in any email we send
- We never use deceptive subject lines
- Every marketing email clearly identifies itself as an advertisement or promotional communication where required
- Every marketing email includes our valid physical mailing address: 2750 S. Preston Rd. #105, Celina, TX 75009
- Every marketing email includes a clear and conspicuous mechanism to opt out of future marketing emails
- We honor opt-out requests promptly
Email consent is not a condition of purchase. Providing your email address for transactional purposes (such as receiving your membership login) does not automatically enroll you in marketing email sequences. Marketing email consent is collected separately and clearly at the point of opt-in.
Membership & Billing
By purchasing a membership through Apex Spine and Sport, you agree to the following:
- The $1 trial provides access to the program for 14 days, after which your membership automatically renews at $97 per month unless cancelled before the trial period ends
- Membership fees are billed on a recurring monthly basis and are processed securely through our payment provider, Whop, which uses Stripe for payment processing
- You may cancel your membership at any time through your Whop account at whop.com/hub or through the Billing section of your member profile in the app. Cancellation takes effect at the end of your current billing period — you retain full access until that date
- We do not offer refunds for partial billing periods except where required by applicable law
- We reserve the right to modify membership pricing with reasonable advance notice to active members
- If a payment fails, your access may be suspended until the payment issue is resolved
Use of the App and Services
Your membership grants you a personal, non-transferable, non-exclusive license to access and use the Apex Spine and Sport app and program materials. You agree not to:
- Share your login credentials or allow others to access your account
- Copy, reproduce, distribute, or resell any program content, exercises, guides, or materials
- Use our content for commercial purposes without prior written consent
- Attempt to reverse-engineer, scrape, or interfere with our app or systems
- Post content in our community that is offensive, harmful, or violates the rights of others
We reserve the right to terminate or suspend your access if these terms are violated without refund.
Intellectual Property
All content within the Apex Spine and Sport program — including exercise guides, videos, written materials, protocol designs, app features, the Apex AI coach system, and branding — is the intellectual property of Dr. Dillan Bollwinkel, DC and Apex Spine and Sport. All rights reserved.
You are granted a limited license to use this content for your own personal recovery and wellness purposes only. Any unauthorized reproduction, distribution, or commercial use of our content is strictly prohibited and may result in legal action.
Community Guidelines
Our app includes a group chat and direct messaging feature. By participating, you agree to:
- Be respectful and supportive of other members at all times
- Not share personal or identifiable medical information of others without their consent
- Not post spam, promotional content, or links to third-party products or services
- Not engage in harassment, bullying, or any form of discriminatory behavior
- Not share login credentials or allow non-members access to community content
- Not provide medical advice to other members — direct members to consult a qualified healthcare provider
We reserve the right to remove any content or permanently revoke community access for violations of these guidelines without refund.
Limitation of Liability
To the fullest extent permitted by applicable law, Apex Spine and Sport and Dr. Dillan Bollwinkel, DC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services, program, app, or any content provided therein.
Our total cumulative liability to you for any and all claims arising from your use of our services shall not exceed the total amount you paid for your membership in the three (3) months immediately preceding the event giving rise to the claim.
You use our program, follow our exercise guidance, and engage with our services at your own risk. By accessing and using our services, you acknowledge that you have read, understood, and agreed to the Medical Disclaimer in Section 1 of these Terms.
Privacy
Your privacy is important to us. Our collection and use of your personal information — including your name, email address, phone number, and any health-related information you voluntarily share — is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our services, you consent to the collection, use, and handling of your information as described in our Privacy Policy. We will never sell your personal information to third parties.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Collin County, Texas.
Before filing any legal claim, you agree to first contact us at apexspineandsport@gmail.com and provide a written description of your dispute. We will attempt to resolve any dispute informally within 30 days of receiving your written notice.
